The following Terms and Conditions govern your use and access of the Eldercare.Market website, including its related sites, features, functions and services (the “Platform”). By accessing and/or using the Platform, you agree to be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, unfortunately you may not continue to access and/or use this Platform.

Access

Access to the Platform is not guaranteed. We reserve the right to suspend or amend the Platform at any time without notice. We will not be liable if for any reason the Platform or any of its functions, features or services is unavailable for a period of time, whether in whole or in part.

We will assume that any use of the Platform made using your User ID and Password (your “Account”) is you, or is authorised by you, and you shall be responsible for all actions taken in the name of your Account. If you believe that your Account has been compromised for any reason, you should notify us in writing immediately.

Certain features or services on the Platform are available only to registered customers with a valid Account with us.

You may not obtain or attempt to obtain unauthorised access to password protected and/or secure areas of the Platform, or to any other protected information, through any means not intentionally made available by us for your specific use. A breach of this provision may be an offence under the Computer Misuse Act (Chapter 50A) of Singapore.

 Purchase

Eldercare.Market is an online marketplace platform and acts as a broker between Vendors and buyers. As such, when you purchase a product through the Platform, the resulting legal contract is between you and the respective Vendor. In addition to these Terms and Conditions, you should also review any further conditions provided on the Vendor’s store or product pages.

We are not responsible for the product listings of our Vendors. You should carefully read the product page and review information such as price, shipping charges, warranty and other relevant product information before purchasing a product. We cannot be responsible for the information provided by our Vendors or the quality of the final product delivered. This disclaimer does not affect your statutory rights against our Vendors.

Payment Security

Transactions on our Platform are handled through Stripe, one of the most secure and trusted online payment processing platforms in the world, used by millions of companies globally. Delivery

Products are sent directly to you from the Vendors. Upon notification of a Customer Order, the Vendor will aim to fulfill the order by shipping the relevant product within the period as specified in the Vendor’s Store or Product page.

Packaging and delivery times may vary if you purchase products from multiple Vendors within the same order. 

Some Vendors may offer the option of self-collection of purchased products at their designated locations. 

Exchange/Returns/Refunds

Product exchanges, returns or refunds shall be done in accordance with the policies of the respective Vendors. For more information and details on the Exchange/Returns/Refunds process, please refer to our Exchange, Returns & Refunds page. 

Restrictions

By accessing and/or using the Platform, you agree and undertake not to:

  1. impersonate any person or entity or to falsely state or otherwise misrepresent your affiliation with any person or entity;
  2. use the Platform for illegal purposes;
  3. attempt to gain unauthorised access to or otherwise interfere or disrupt other computer systems or networks connected to the Platform;
  4. post, promote or transmit through the Platform any false, offensive, misleading, defamatory, libellous or illegal material;
  5. interfere with another’s utilisation and enjoyment of the Platform;
  6. use or upload, in any way, any software or material that contains, or which you have reason to suspect that contains, viruses, damaging components, malicious code or harmful components which may impair or corrupt the Platform’s data or damage or interfere with the operation of another Platform user’s computer or mobile device or the Platform; and
  7. use the Platform other than in conformance with the acceptable use policies of any connected computer networks, any applicable Internet standards and any other applicable laws.

Privacy Policy

You acknowledge that you have read and agree to our Privacy Policy and consent to our collection, use and disclosure of your personal information for the purposes as set out in the Privacy Policy.

Enquiries and Complaints

If you have any enquiries or complaints, you may either contact the Vendor directly via the Platform or contact Eldercare.Market using the “Contact Us” page on the Platform, as applicable.

In the event that you are unable to resolve any dispute with the Vendor directly through amicable negotiations, we reserve the right to suggest and implement an appropriate resolution at our sole discretion. You agree to release us (and our officers, directors, agents, subsidiaries, joint ventures and employees) from all claims, demands and damages, actual and consequential, of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.

Termination

We reserve the right to stop access, refuse service, terminate accounts, edit or remove content, or cancel orders for any reason at our sole discretion, with or without notice or liability to you or any third party.

You may terminate your Account with us by notifying us in writing of your desire to do so.

Force Majeure

We shall not be liable for non-performance, error, interruption or delay in the performance of any obligations under these Terms and Conditions, or for any inaccuracy, unreliability or unsuitability of the Platform’s contents if this is due, in whole or in part, directly or indirectly to an event or failure which is beyond our reasonable control.

Applicable Law and Jurisdiction

Access and/or use of the Platform and these Terms of Use shall be governed by and construed in accordance with the laws of Singapore.

General

If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Headings are for reference purposes only and do not limit the scope or extent of such section.

We do not guarantee we will take action against all breaches of these Terms and Conditions. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. We would still be entitled to use our rights and remedies in any other situation where you breach these Terms and Conditions.

We may amend these Terms and Conditions at any time by posting the amended terms on this site. Unless otherwise specified, all amended terms shall automatically be effective after they are posted.
